These Terms and Conditions of Use (“Terms”) govern your purchase and use of physical products sold by Pure Crumb LLC, located at 1401 21st Street #7047, Sacramento, CA 95811 (“Company,” “we,” “us,” or “our”).

By accessing our website or purchasing our products, you agree to be bound by these Terms and our Privacy Policy.

1. Eligibility and Use

You must be at least 18 years of age or the age of majority in your jurisdiction to purchase from our website. By placing an order, you represent that you meet this requirement.

Use of this website is at your own risk. We make reasonable efforts to maintain a secure and reliable website but do not guarantee uninterrupted or error-free operation.

2. Products and Sales

All products sold by Pure Crumb are physical food products, including but not limited to grain-free sourdough starter kits and related items.

Product descriptions, images, and specifications are provided for informational purposes only. Minor variations in appearance or packaging do not constitute defects.

3. Pricing, Payment, and Taxes

All prices are displayed at checkout and are subject to change without notice for future purchases.

You authorize us to charge your selected payment method for the total amount displayed, including applicable taxes and shipping fees.

Payments are processed securely through Stripe or other third-party payment processors. We do not store full payment card information.

Sales tax will be applied as required by law based on shipping destination.

4. Shipping, Delivery, and Risk of Loss

Orders are shipped to the address provided at checkout. You are responsible for ensuring shipping information is accurate and complete.

Risk of loss transfers to you upon confirmed delivery by the carrier.

We are not responsible for:

  • Carrier delays
  • Packages marked as delivered but not received
  • Errors caused by incorrect or incomplete addresses

If a shipment is lost or delayed, you must contact the carrier directly to initiate a claim.

5. Refunds, Returns, and Damaged Goods

All sales are final.

Due to the perishable and consumable nature of our food products, we do not accept returns or exchanges once an order has shipped.

Limited Exception for Damaged or Incorrect Orders

If your order arrives damaged, defective, or incorrect, you must:

  • Notify us at orders@purecrumb.com within 5 days of delivery
  • Include clear photographic evidence of the issue and the shipping packaging

If approved at our sole discretion, we may issue:

  • A replacement product, or
  • Store credit

Refunds are not provided.

Failure to notify us within this timeframe constitutes acceptance of the product as delivered.

6. Price Adjustments

We do not offer price adjustments, retroactive discounts, or promotional matching after purchase.

7. Chargebacks and Payment Disputes

By completing your purchase, you agree to contact us directly with any billing or fulfillment concerns prior to initiating a chargeback or payment dispute.

Chargebacks initiated without first contacting us constitute a breach of these Terms.

In the event of a chargeback or dispute, we reserve the right to:

  1. Submit evidence to Stripe, card networks, or financial institutions, including proof of shipment, delivery confirmation, photographs, and acceptance of these Terms
  2. Suspend or cancel any pending or future orders
  3. Restrict the customer from future purchases

Fraudulent or abusive chargebacks may result in permanent account termination.

8. Order Cancellation and Refusal

We reserve the right to refuse or cancel any order, in whole or in part, for any lawful reason, including suspected fraud, abuse, or resale activity.

If an order is canceled prior to shipment, a refund will be issued to the original payment method.

9. No Resale or Distribution

Products sold by Pure Crumb are for personal use only.

We prohibit resale, redistribution, or commercial use of our products without prior written consent. Orders suspected of resale activity may be canceled and accounts restricted.

10. Intellectual Property

All website content, product names, branding, images, and materials are owned by or licensed to Pure Crumb LLC and are protected by intellectual property laws.

You may not copy, reproduce, distribute, or use our intellectual property without prior written permission.

11. User Submissions and Reviews

By submitting reviews, photos, or other content, you grant us a non-exclusive, royalty-free license to use such content for legitimate business purposes.

We reserve the right to moderate or remove content that is unlawful, offensive, misleading, or otherwise inappropriate.

Nothing in these Terms restricts lawful consumer reviews or opinions.

12. Disclaimers and Warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

Results from food preparation may vary based on individual handling, environment, and techniques.

13. Limitation of Liability

To the fullest extent permitted by law, Pure Crumb LLC shall not be liable for any indirect, incidental, consequential, or special damages arising from the purchase or use of our products.

Our total liability shall not exceed the amount paid for the product giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Pure Crumb LLC and its owners, officers, employees, and agents from any claims, damages, or expenses arising from your misuse of our products or violation of these Terms.

15. Termination

We reserve the right to restrict or terminate access to our website or future purchases for violations of these Terms or abusive behavior.

16. Dispute Resolution

Before initiating any legal action, you agree to attempt good-faith resolution by contacting us directly.

If unresolved, disputes shall be governed by the laws of the State of California.

17. Govenring Law and Jurisdiction

These Terms are governed by the laws of the State of California. Any legal action shall be brought in a court of competent jurisdiction within California.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pure Crumb LLC.

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
